Terms of Service
Enacted: August 1, 2025
Article 1 (Application)
These Terms of Service (hereinafter referred to as "these Terms") establish the terms of use for Museum Notes (hereinafter referred to as "this service"). Users who use this service (hereinafter referred to as "users") are deemed to have agreed to these Terms.
This service is operated by GIJIN LAB (hereinafter referred to as "our company").
Article 2 (Definitions)
1. "This service" refers to a service that provides art appreciation, storage of viewing records, and history management as a digital museum.
2. "User" refers to an individual who registers for this service and uses this service.
3. "Viewing record" refers to a record created when a user views artwork in this service.
Article 3 (Usage Registration)
1. Those who wish to use this service shall apply for usage registration by the method prescribed by our company after agreeing to these Terms.
2. Applicants for usage registration must agree to these Terms and Privacy Policy.
3. We may not approve applications for usage registration if we determine that the applicant has any of the following reasons.
- When the application is from a person who has violated these Terms
- Other cases where we determine that usage registration is inappropriate
Article 4 (Usage Fees)
This service is currently provided free of charge.
Article 5 (Management of Email Address and Password)
1. Users shall properly manage the email address and password for this service at their own responsibility.
2. Users may not transfer or lend their email address and password to third parties or share them with third parties under any circumstances.
3. We assume no responsibility for any damage caused by inadequate management of email address and password, errors in use, use by third parties, etc.
Article 6 (Prohibited Acts)
Users shall not perform the following acts when using this service.
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal acts
- Acts that destroy or interfere with the functions of our servers or networks
- Acts that may interfere with the operation of this service
- Acts of collecting or accumulating personal information about other users
- Acts of impersonating other users
- Other acts that we determine to be inappropriate
Article 7 (Suspension of Service Provision)
1. We may suspend or discontinue all or part of this service without prior notice to users if we determine that any of the following reasons exist.
- When performing maintenance inspection or updates of computer systems related to this service
- When the provision of this service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
- Other cases where we determine that it is difficult to provide this service
2. We assume no responsibility for any damage caused to users or third parties due to the suspension or discontinuation of this service.
Article 8 (Copyright)
1. The copyright of artworks displayed in this service belongs to each copyright holder. However, for works based on Creative Commons licenses, the terms of the relevant license apply.
2. Users may not reproduce, reprint, modify, etc. images of artworks displayed in this service beyond the scope of private use.
3. The copyright of viewing records created by users in this service belongs to the relevant user. Viewing records are not shared with other users and are only accessible to the user who created them.
Article 9 (Usage Restrictions and Registration Deletion)
1. We may restrict all or part of this service or delete the user's registration without prior notice if the user falls under any of the following categories.
- When the user violates any provision of these Terms
- When it is found that there are false facts in the registered information
- Other cases where we determine that the use of this service is inappropriate
2. We assume no responsibility for any damage caused to users by acts performed by us based on this article.
Article 10 (Withdrawal)
Users may withdraw from this service through the withdrawal procedure prescribed by our company. When withdrawing, the user's viewing records and account information will be deleted.
Article 11 (Disclaimer and Exemption)
1. We will pay maximum attention within a reasonable range regarding the safety, reliability, and accuracy of this service, but we do not guarantee completeness.
2. We assume no responsibility for any damage caused to users due to this service, except in cases of our intentional or gross negligence.
Article 12 (Changes to Service Content)
We may change the content of this service or discontinue the provision of this service, and we assume no responsibility for any damage caused to users as a result.
Article 13 (Changes to Terms of Service)
We may change these Terms when we deem it necessary. In addition, if the use of this service continues after the change of these Terms, it is deemed that the user has agreed to the changed terms.
Article 14 (Notification or Contact)
Notifications or communications between users and our company shall be made by the method prescribed by our company. Unless we receive a notice of change from the user in accordance with the method separately prescribed by our company, we will consider the currently registered contact information as valid and send notifications or communications to that contact, and these are deemed to have reached the user at the time of transmission.
Article 15 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer their status under the usage contract or rights or obligations based on these Terms to third parties or provide them as security without our prior written consent.
Article 16 (Governing Law and Jurisdiction)
1. Japanese law shall be the governing law for the interpretation of these Terms.
2. In the event of a dispute regarding this service, the Chiba District Court shall be the exclusive agreed jurisdiction.
